- Definitions
“We / Us / Our” means Apex Blinds Ltd, trading as Apex Elite.
“You / Customer” means the person, business, or trade customer placing the
order.
“Goods” means made-to-measure blinds, shutters, curtains, awnings,
motors, and related products supplied by us.
“Installation” means fitting carried out by us (excluding trade supply-only
orders).
- Quotations
All quotations are valid for 30 days unless stated otherwise.
Quotes are based on information available at the time, including access, site
conditions, and measurements.
Any changes requested after acceptance may result in a revised price and/or
lead time. - Made-to-Measure Products
All orders are custom-made to your measurements and specifications.
As goods are made to measure, orders cannot be cancelled once
manufacturing has started, except where required by law. - Deposits & Payments
A 50% deposit is required to place an order and begin manufacture.
The remaining 50% balance is due on the day of fitting, before or
immediately upon completion.
For trade supply-only customers, payment terms will be as agreed in
writing.
We reserve the right to delay delivery or installation if payment terms are not
met. - Ownership of Goods
All goods remain our property until paid for in full, even after installation. - Measuring Responsibility
Where we carry out the survey and measurements, we take responsibility
for accuracy.
Where measurements are provided by the customer or a third party,
responsibility rests with them, and we cannot accept liability for incorrect
sizing.
- Installation & Access
You must provide safe, clear access to the installation area on the agreed
date.
We are not responsible for delays caused by:
o Restricted access
o Unsafe working conditions
o Structural issues not apparent at survey stage
Additional visits caused by lack of access or unfinished works may be
chargeable. - Surfaces & Existing Conditions
Installation may involve drilling into walls, ceilings, tiles, brickwork, or window
frames.
We are not responsible for:
o Pre-existing defects
o Cracking, flaking plaster, loose tiles, hidden pipes or cables, or fragile
surfaces
Any making good beyond normal fitting (e.g. plaster repair, painting, electrical
works) is not included unless agreed in writing.
- Delivery & Lead Times
Lead times are estimates, not guaranteed dates.
Delays may occur due to manufacturing, supplier issues, weather (particularly
for awnings), or circumstances beyond our control.
We will keep you informed of any significant delays. - Child Safety
We comply with current UK child safety regulations for blinds and window
coverings.
Where applicable, blinds will be supplied and installed with appropriate child
safety devices, such as cleats, tension devices, or cordless systems.
These safety devices reduce the risk of strangulation but are only effective if
used correctly and maintained.
Customer Responsibilities
The customer is responsible for:
o Ensuring safety devices remain properly fitted and used
o Keeping blind cords and chains out of reach of children
o Supervising children around window coverings
Safety devices must not be removed, altered, or disabled.
Changes After Installation
We cannot be held responsible for child safety issues arising from:
o Alterations made after installation
o Furniture placed near blind cords or chains
o Damage, misuse, or removal of safety devices
Trade Customers
Trade customers accept full responsibility for child safety compliance,
correct installation, and providing safety warnings to the end user.
- Cancellations & Consumer Rights
Your statutory rights under the Consumer Rights Act 2015 are not affected
by these Terms & Conditions.
As goods are made to measure, the usual 14-day cancellation right does
not apply once manufacture has begun, unless goods are faulty or not as
described. - Warranty & Guarantees
Workmanship / Installation Guarantee:
o We provide a 1-year guarantee on our installation workmanship.
Manufacturer’s Warranty:
o Standard products: 1 year
o Motors: 5 years
Warranties do not cover:
o Fair wear and tear
o Accidental damage
o Misuse or lack of maintenance
o Alterations or repairs carried out by others
- Defects & Snagging
Any defects or issues must be reported within a reasonable time after
installation.
We must be given the opportunity to inspect and remedy issues before any
third-party repairs are arranged. - Limitation of Liability
We are not liable for:
o Indirect or consequential losses
o Loss of earnings or business interruption
Our liability is limited to the value of the goods and services supplied,
except where the law states otherwise. - Trade Customers (Supply Only)
Trade customers are responsible for:
o Measurements
o Suitability of goods
o Installation and regulatory compliance
Goods supplied to trade are non-returnable, unless faulty. - Force Majeure
We are not responsible for delays or failure caused by events beyond our
control, including supplier delays, weather conditions, illness, or material
shortages.
- Governing Law
These Terms & Conditions are governed by the laws of Northern Ireland,
and any disputes will be subject to its courts.
